MONAYA SPIRIT general conditions of sale (as of 09.15.2023):

Applicable law and legal forum:
The applicable law is Swiss law and any dispute will be handled by the courts of Geneva/Switzerland.
Any validation of an order on the site www.monayaspirit.com will constitute acceptance of these general conditions of sale.

Legal Age:
All orders will be refused to minors (under 18) and those not capable of discernment.

Prices :
The prices indicated are amounts excluding taxes and delivery costs. Visitors from outside Switzerland will be offered prices excluding VAT and excluding transit costs.
MONAYA SPIRIT reserves the right to decline a sale outside Switzerland in the event of export costs considered too high in proportion to the order placed.
The pricing of items is adjustable at any time. The validation of an order accompanied by payment by the customer ensures the purchase of the good at the price indicated during the transaction, subject to availability of the product in our stock. Inventory management is carried out in real time. However, some products may be out of stock. In the event of unavailability of an ordered product, we will cancel or modify the order according to the customer's wishes.

Guarantee :
The guarantee takes effect on the date of delivery of the item, justified by the accompanying document (invoice) which we ask to keep carefully. The customer is responsible for checking the condition of the ordered item(s) himself immediately upon receipt, in the company of the delivery person.
In the event of damage noted on the product, the customer will take a photo of the damage, which he must send to MONAYA SPIRIT and who will be responsible for sending a new product, if available and according to the conditions mentioned under the “return or exchange of goods” section. The customer is responsible for filing a claim with the delivery service for compensation.
MONAYA SPIRIT considers that any product accepted on delivery is considered compliant, validated by the customer and therefore, no subsequent returns or exchanges will be accepted.

Availability :
MONAYA SPIRIT, in principle, is responsible for storing the products put on sale. However, our commitment is void in the event of failure or non-compliance with supply deadlines on the part of our own suppliers. In order to avoid any inconvenience, the website informs the customer in real time whether a product is available, deliverable on time or out of stock. If, despite everything, a product should still be unavailable, MONAYA SPIRIT will inform you as soon as possible.

Payment terms :
Payment upon order.
Payment methods: cash (if withdrawn from our deposit), bank transfer (send upon receipt of funds), twint, online payment.

Delivery and transport:
The items are sent by delivery person or by post within approximately 2 to 14 days. Shipping costs are charged to the customer and vary depending on the rates of our partners, the weight of the package and the option chosen by the customer.
PLEASE NOTE: MONAYA SPIRIT does not send packages to post office boxes, nor to minors or customers under guardianship, without written authorization from the parents or guardian. Any person wishing to enter the site www.monayaspirit.com certifies on their honor that they are of legal age and capable of discernment.

Return or exchange of goods:

The customer is solely responsible for the order he validates. Therefore, no returns are accepted. However, an order modification can be made at the discretion of MONAYA SPIRIT, before shipment. Under no circumstances can an order be exchanged after shipment.
EXCEPTION: if the customer notices that the ordered goods arrive damaged (in the presence of the delivery person), he will refuse the package which will return to MONAYA SPIRIT, which will exchange and send a new item (under condition for justifying a customer complaint to the delivery service).
Once all conditions are met, MONAYA SPIRIT will cover the shipping costs relating to the new shipment.

Legal guarantee:
Check the condition of the delivered goods immediately to exclude obvious material and manufacturing defects, as well as transport damage. In accordance with the law, the customer is obliged to notify MONAYA SPIRIT of any defect or anomaly affecting the goods delivered to enable us to remedy them.

Data protection :
All personal data will be considered confidential. The information necessary for managing the order will be subject to computer processing and may be communicated to associated companies as part of the management of the order.
